Welcome to CoffeePic.
The terms “we”, “us” and “our” refer to CoffeePic. CoffeePic operates this online store and website, including all related information, content, features, tools, products and services offered to you, the customer (collectively, the “Services”).
Our store is powered by Shopify, which enables us to provide the Services.
These Terms of Service (“Terms”), together with any policies referenced in these Terms, describe your rights and responsibilities when accessing or using the Services.
Please read these Terms carefully. They contain important information regarding your legal rights, including provisions relating to warranties, liability and consumer rights.
By visiting, interacting with or using the Services, or purchasing products through our store, you agree to these Terms and acknowledge our Privacy Policy.
If you do not agree with these Terms, you should not use the Services.
Nothing in these Terms is intended to exclude, restrict or modify any statutory consumer right, guarantee, warranty or remedy that cannot lawfully be excluded, restricted or modified under applicable law.
SECTION 1 – ACCESS AND ACCOUNTS
By using the Services, you confirm that you are legally capable of entering into a binding agreement in your jurisdiction or that you have the appropriate consent or authority required by applicable law.
To access certain features or purchase products, you may be required to provide information including your email address, billing details, payment information and shipping address.
You agree that the information you provide is accurate, current and complete and that you have the right to provide that information.
If you create an account, you are responsible for maintaining the confidentiality and security of your account credentials and for activity carried out through your account, except where applicable law provides otherwise.
You may not sell, transfer or assign your customer account to another person without our permission.

We make reasonable efforts to display and describe our products accurately.
However, colours and appearance may vary slightly depending on your device, screen settings, lighting and other factors outside our control.
Product images may be illustrative and minor variations may occur where they do not materially affect the nature or functionality of the product.
Nothing in this section limits your rights where a product is faulty, defective, damaged, unsafe, materially different from its description, not fit for an applicable purpose or otherwise fails to meet mandatory consumer guarantees.
Product descriptions, availability and specifications may be updated from time to time.
We reserve the right to discontinue products or limit quantities available for purchase, subject to applicable law.
SECTION 3 – ORDERS
When you submit an order, you are making an offer to purchase the products included in that order.
Receipt of an automated order confirmation does not necessarily mean that your order has been finally accepted.
We may refuse or cancel an order where reasonably necessary, including because of product unavailability, suspected fraud, payment problems, material pricing or listing errors, restrictions on delivery or other legitimate reasons.
Where we cancel an order after payment has been received, we will provide any refund required by applicable law.
Please review your order carefully before completing your purchase.
If you wish to cancel or modify an order, contact us as soon as possible at coffeepic@outlook.com. We cannot guarantee that an order can be changed or cancelled after it has entered processing or fulfilment.
Returns, exchanges and refunds are governed by our Returns & Refunds Policy, together with any mandatory rights available under applicable consumer law.
Unless otherwise agreed, products purchased through our store are intended for personal or household use and not for unauthorised commercial resale.
SECTION 4 – PRICES, TAXES AND BILLING
Prices, discounts and promotions may change from time to time.
The price applicable to your purchase will generally be the price displayed when you place your order, subject to correction of genuine errors and applicable law.
Any applicable shipping charges, taxes, duties or other charges will be displayed or communicated where required.
For international orders, customs duties, import taxes or similar government charges may apply depending on the destination country.
Where these charges are not collected by us at checkout, they may be charged separately by the relevant authority or delivery provider.
Nothing in this section makes you responsible for charges that applicable law requires CoffeePic to pay.
You agree to provide accurate and complete billing, payment and account information and to update information where reasonably necessary to complete your transaction.
By providing a payment method, you confirm that you are authorised to use that payment method.
SECTION 5 – SHIPPING AND DELIVERY
Delivery times displayed on our website are estimates unless expressly stated otherwise or applicable law requires a specific delivery timeframe.
Delivery may occasionally be affected by circumstances outside our reasonable control, including carrier disruptions, customs procedures, severe weather, strikes, natural disasters or other unforeseen events.
We will take reasonable steps to fulfil orders and address delivery issues.
Any provision relating to delivery, ownership or risk of loss will apply only to the extent permitted by applicable law.
Where mandatory consumer law provides that CoffeePic remains responsible for goods until they are delivered to you, or to a person designated by you, those legal protections will apply.
We do not exclude liability for loss, non-delivery or damage where responsibility cannot lawfully be excluded.

SECTION 6 – INTELLECTUAL PROPERTY
The Services and their content, including CoffeePic branding, logos, product photography, graphics, videos, text, website design and other original materials, are owned by or licensed to CoffeePic or the applicable rights holder and may be protected by copyright, trademark and other intellectual property laws.
You may use the Services for lawful personal and non-commercial purposes.
Unless permitted by applicable law or authorised by us in writing, you may not reproduce, distribute, modify, republish, commercially exploit or create derivative works from our protected content.
Nothing in these Terms transfers ownership of CoffeePic's intellectual property to you.
Shopify's names, trademarks, logos and other intellectual property remain the property of Shopify or its respective rights holders.
Third-party trademarks and intellectual property appearing through the Services remain the property of their respective owners.
SECTION 7 – OPTIONAL THIRD-PARTY TOOLS
We may provide access to tools, integrations or services supplied by third parties.
We may not control or monitor those third-party services.
Your use of third-party tools may also be governed by the applicable third party's terms and privacy policies.
To the maximum extent permitted by law, we are not responsible for third-party tools or services that we do not own or control.
Nothing in this section excludes liability or consumer rights that cannot legally be excluded.
We may introduce additional features, tools or resources in the future. Unless otherwise stated, those features will form part of the Services and will be subject to these Terms.
SECTION 8 – THIRD-PARTY LINKS
The Services may contain links to third-party websites, services or platforms.
We do not necessarily control, endorse or assume responsibility for third-party websites or their content.
If you access a third-party website, you should review its applicable terms, privacy policies and other relevant policies.
Transactions entered into directly with third parties may be governed by the terms between you and that third party.
Nothing in this section excludes any liability that cannot legally be excluded.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
CoffeePic is powered by Shopify, which enables us to provide the Services.
However, purchases made from the CoffeePic store are transactions between you and CoffeePic, rather than purchases from Shopify.
Shopify is not the seller of CoffeePic products merely because Shopify provides the ecommerce technology used by our store.
To the extent permitted by applicable law, Shopify and its affiliates are not responsible for the products sold by CoffeePic or for obligations that legally belong to CoffeePic as the merchant.
Nothing in this section limits rights or remedies that cannot lawfully be excluded.
SECTION 10 – PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Because our store is powered by Shopify, Shopify may also collect and process personal information relating to your access to and use of the Services.
Information may be transmitted to Shopify and other service providers located in countries different from your country of residence where necessary to provide the Services.

Shopify's own privacy practices are governed by its applicable privacy notices and policies.
SECTION 11 – REVIEWS, FEEDBACK AND USER CONTENT
If you voluntarily submit reviews, photographs, videos, suggestions, ideas, feedback or other content to CoffeePic (“User Content”), you confirm that you have the necessary rights to submit that content.
To the extent permitted by law, you grant CoffeePic a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, distribute, adapt and publish User Content for purposes connected with operating, improving and promoting CoffeePic and the Services.
This licence does not transfer ownership of your User Content to CoffeePic.
You confirm that your User Content will not knowingly:

Infringe another person's intellectual property or privacy rights.

Contain unlawful, defamatory, abusive or malicious material.

Contain malware or harmful code.

Misrepresent your identity or the origin of the content.

Contain false or misleading claims.
Where a review or endorsement was provided in exchange for compensation, a free product, discount or other material incentive, any disclosure required by applicable advertising or consumer law must be made.
We may moderate or remove User Content where reasonably necessary, including where it violates these Terms or applicable law.
SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS
Occasionally, information on the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, availability, shipping charges or delivery estimates.
We may correct genuine errors and update inaccurate information.
If a material error affects an order you have already placed, we will handle the matter in accordance with applicable law and will not use this section to remove mandatory consumer rights.
SECTION 13 – PROHIBITED USES
You may only use the Services for lawful purposes.
You must not use the Services to:

Automated systems, bots, agents, scraping technologies and similar tools must not access or interact with the Services in a way that violates applicable law, these Terms or reasonable technical restrictions implemented by CoffeePic or our service providers.
Automated systems must not:

SECTION 15 – SUSPENSION AND TERMINATION
We may suspend or terminate access to the Services where reasonably necessary, including where a user materially violates these Terms, engages in fraudulent or unlawful conduct, threatens the security of the Services or abuses our systems.
Termination does not affect rights or obligations that arose before termination.
Provisions that by their nature should continue after termination, including intellectual property, liability, dispute and privacy provisions, may continue to apply.
SECTION 16 – WARRANTIES AND CONSUMER GUARANTEES
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, warranty, condition, right or remedy that cannot lawfully be excluded, restricted or modified.
To the maximum extent permitted by law, and only in relation to matters that may legally be excluded, the Services are provided on an “as available” basis.
We do not guarantee that the website will always operate uninterrupted or without technical errors.
This limitation does not affect your rights regarding products purchased from CoffeePic.
Australian Customers
For transactions to which the Australian Consumer Law (ACL) applies, our goods come with consumer guarantees that cannot be excluded under Australian law.
Depending on the circumstances, you may be entitled to a repair, replacement, refund, compensation or another remedy where goods fail to satisfy an applicable consumer guarantee.
Nothing in these Terms is intended to exclude, restrict or modify rights available under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.
United Kingdom Customers
Nothing in these Terms affects statutory rights available to consumers under applicable United Kingdom consumer protection law, including mandatory rights relating to goods, digital transactions, online purchases and cancellation where applicable.
European Union Customers
Consumers located in the European Union may also have mandatory rights under applicable EU and national consumer protection laws.
These Terms do not override mandatory rights that apply to those transactions.
SECTION 17 – LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms is intended to exclude or restrict liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where such liability cannot lawfully be excluded, or any mandatory consumer right or remedy.
To the maximum extent permitted by applicable law, CoffeePic will not be liable for indirect or consequential losses that were not reasonably foreseeable when the relevant contract was formed or that arise from circumstances for which liability may legally be limited.
If you use the Services for commercial or business purposes, additional limitations may apply to the maximum extent permitted by law.
For consumers, this section will always be interpreted subject to applicable mandatory consumer protection laws.
SECTION 18 – INDEMNIFICATION
To the extent permitted by applicable law, you agree to be responsible for losses, liabilities or reasonable costs arising directly from your unlawful use of the Services, your material breach of these Terms or your infringement of another person's rights.
This provision does not require a consumer to indemnify CoffeePic for losses caused by CoffeePic's own unlawful conduct, negligence or breach where such an obligation would be prohibited or unfair under applicable law.
SECTION 19 – SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary to make it enforceable where legally possible.
If that is not possible, the affected provision will be severed.
The remaining provisions will continue in effect to the extent permitted by law.
SECTION 20 – WAIVER AND ENTIRE AGREEMENT
If we do not immediately exercise or enforce a right under these Terms, that does not necessarily mean we have waived that right.
These Terms, together with policies and other terms expressly incorporated into them, constitute the agreement governing your use of the Services, subject to any rights or terms that applicable law requires to apply.
Nothing in this section excludes representations, rights or remedies that cannot legally be excluded.
SECTION 21 – ASSIGNMENT
You may not transfer your rights or obligations under these Terms where doing so would materially affect CoffeePic without our prior written consent, except where applicable law gives you the right to do so.
We may transfer our rights or obligations in connection with a legitimate business restructuring, sale or transfer, provided that doing so does not unlawfully reduce your consumer rights.
SECTION 22 – GOVERNING LAW AND JURISDICTION

These Terms and any contractual relationship between you and CoffeePic will generally be governed by the laws of England and Wales, except where mandatory consumer protection or conflict-of-law rules provide that the laws of another jurisdiction apply to you.
If you are a consumer residing outside England and Wales, nothing in these Terms deprives you of mandatory protections available under the laws of your country of residence where those protections legally apply.
Nothing in these Terms requires a consumer to bring proceedings exclusively in England and Wales where applicable law gives that consumer the right to bring proceedings in another competent jurisdiction.

Headings are included for convenience only and do not limit or otherwise affect the interpretation of these Terms.
SECTION 24 – CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our Services, business practices or legal and regulatory requirements.
The latest version will be published on our website.
Where required by applicable law, we will provide appropriate notice of material changes.
Changes will not retrospectively remove rights that have already arisen under an existing purchase or contract where doing so would be prohibited by law.
